According to Apple's web site,

<http://www.apple.com/opensource/>

the current release of Darwin/MacOS X uses libc from BSD 5.0/5.1, but 
also portions of the 4.8 BSD kernel.

I assume it's these portions of the 4.8 kernel you're worried about?
